By accessing or using the LinkLink platform, mobile application, or any related services (collectively, the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and LinkLink Fitness, LLC (“LinkLink,” “we,” “us,” or “our”), a Michigan limited liability company.

LinkLink is a fitness data integration and coaching platform that allows personal trainers and athletes to aggregate, view, and route data from third-party fitness platforms and wearable devices. The Service may include:

• Aggregation of fitness and activity data from connected third-party platforms
• Data routing and synchronization between connected platforms
• AI-powered insights and coaching tools for personal trainers
• Communication tools between trainers and athletes

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. LinkLink is not liable for any loss resulting from unauthorized use of your account.

The Service connects to third-party fitness platforms and wearable device ecosystems (collectively, “Connected Platforms”) to retrieve and route your fitness data. By connecting a third-party account, you:

• Authorize LinkLink to access, retrieve, and display data from that platform on your behalf
• Authorize LinkLink to route or sync data between Connected Platforms as directed by you or your trainer
• Acknowledge that your use of each Connected Platform remains subject to that platform’s own terms of service and privacy policy
• Understand that LinkLink is not responsible for the availability, accuracy, or behavior of any Connected Platform

We do not guarantee uninterrupted access to any Connected Platform and reserve the right to add, remove, or modify integrations at any time.

The Service processes fitness and health-related data, including but not limited to activity metrics, heart rate, sleep, recovery scores, training load, and GPS data (“Fitness Data”). By using the Service, you acknowledge and agree that:

• You voluntarily provide Fitness Data by connecting third-party accounts
• LinkLink is not a healthcare provider and the Service is not a medical device
• Nothing in the Service constitutes medical advice, diagnosis, or treatment
• You should consult a qualified healthcare professional before making health or training decisions based on data provided by the Service
• LinkLink is not a HIPAA-covered entity and the Service is not subject to HIPAA, though we take reasonable measures to protect your data as described in our Privacy Policy

By providing your mobile phone number and opting in to SMS communications, you authorize LinkLink Fitness, LLC to send recurring automated transactional and product-related text messages to the mobile number provided, including messages related to your account, activity alerts, and platform updates.

• Consent is not required as a condition of any purchase or use of the Service
• Message frequency varies based on your account activity and settings
• Message and data rates may apply depending on your mobile carrier and plan
• To opt out at any time, reply STOP to any message from us

LinkLink is not liable for delays or failures in SMS delivery due to factors outside our control, including carrier issues or device settings.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service or Connected Platforms
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit harmful, abusive, or fraudulent content
• Resell or commercially exploit the Service without our written consent

All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and the LinkLink brand — are the exclusive property of LinkLink Fitness, LLC and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. LinkLink does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Service is at your sole risk.

To the fullest extent permitted by law, LinkLink Fitness, LLC and its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.

You agree to indemnify and hold harmless LinkLink Fitness, LLC and its members, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us at hello@linklink.fit.

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Michigan.

We reserve the right to update these Terms at any time. We will notify you of material changes by updating the effective date above or by sending notice through the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
